These terms govern the use of fynorvexa.com and the services of Fynorvexa BV as a crowdfunding service provider under Belgian law.

1. Identification

Fynorvexa BV, registered office at Sint-Goriksplein 14, 1000 Brussels, registered with the Crossroads Bank for Enterprises under number 0788.452.319, VAT BE 0788.452.319, incorporated in 2018, registered with the FSMA as a crowdfunding service provider under Regulation (EU) 2020/1503.

2. Acceptance

By registering or using the website you declare that you have read, understood and unconditionally accept these terms. If you do not agree to these terms, please do not use the platform.

3. Appropriateness assessment

In line with article 21 of Regulation (EU) 2020/1503, we run a test of acceptable knowledge and a loss-bearing simulation for non-sophisticated investors. The outcome is for warning purposes only.

4. Reflection period

Non-sophisticated investors have a reflection period of four calendar days during which a commitment can be revoked without reason and without cost.

5. Fees

Fynorvexa does not charge any entry or management fees to investors. Our remuneration is paid directly by the developer and is transparently disclosed in the Key Investment Information Sheet.

6. Risk

Real estate crowdlending is a risk investment, including the risk of partial or total loss of the invested capital, delay, restructuring or developer insolvency. Always read the KIIS before subscribing.

7. Intellectual property

All content on fynorvexa.com (text, photographs of Belgian projects, source code, trademarks) is owned by Fynorvexa BV or its licensors and may not be reproduced without prior written consent.

8. Liability

Fynorvexa acts as an intermediary service provider and is not a party to the loan agreement between the investor and the developer. Save for wilful misconduct or gross negligence, our liability is limited to the amount of remuneration received for the file concerned.

9. Complaints and ADR

Complaints can be filed via klachten@fynorvexa.com. If no amicable solution is reached, you may turn to Ombudsfin (North Gate II, Koning Albert II-laan 8, 1000 Brussels) or to the European ODR platform.

10. Governing law

These terms are governed by Belgian law. Disputes fall under the exclusive jurisdiction of the Dutch-speaking courts of the Brussels district, without prejudice to mandatory consumer rights.
